JDS Dental Sdn Bhd, trading as JDental Specialists (“we”, “us”, “our”), respects your privacy. This notice explains how we collect, use, disclose and protect your personal data when you use this website (www.jdentalspecialists.com), contact us, or receive care at our clinic, in line with Malaysia’s Personal Data Protection Act 2010 (“PDPA”).
By using this website, contacting us, or providing your personal data to us, you consent to us collecting, using and disclosing it as described in this policy. This policy forms part of our Terms of Service.
1. Who we are
JDental Specialists is a multi-specialty dental group practice operated by JDS Dental Sdn Bhd, at 71, Jalan Harimau Tarum, Taman Abad, 80250 Johor Bahru, Johor, Malaysia. We are responsible for the personal data described in this notice.
2. Personal data we collect
- Contact details such as your name and phone number, when you call, WhatsApp or visit us.
- Referral details you enter in our patient or doctor referral forms: patient name, phone number, services of interest and, for dentists, your name, the tooth or region and remarks. These forms do not send anything to our servers. They open WhatsApp with a pre-filled message, and we only receive the details if you choose to send that message.
- Health and treatment information when you become our patient, including medical and dental history, examination findings, X-rays and 3D scans, clinical photographs, treatment plans and payment records. This is sensitive personal data and we handle it with extra care.
- Identity details such as your NRIC or passport number, date of birth and address, needed to register you as a patient.
- Website usage data collected automatically through cookies and similar technologies (see section 5).
If you give us personal data about someone else, such as a child you are bringing for treatment or a patient you are referring, you confirm that you are entitled to do so and that they have agreed to it.
Giving us your personal data is voluntary, but if you do not provide the information we ask for, or it is inaccurate or incomplete, we may be unable to treat you safely, or at all.
3. How we use your personal data
- To respond to your enquiries and arrange, confirm and remind you of appointments.
- To assess, diagnose and treat you, and to keep accurate clinical records.
- To coordinate your care between our specialists and with your referring dentist or doctor.
- To process payments, insurance and panel claims.
- To meet our legal and regulatory obligations as a private healthcare facility.
- To understand how our website is used and to measure our online advertising.
- To protect our legal rights, handle complaints and claims, and for audit, insurance and quality-assurance purposes.
- In de-identified or anonymised form, for clinical audit, training, education and research. Data that no longer identifies you is not personal data.
We will only use your clinical photographs or before-and-after images on this website or social media with your separate, explicit consent, and we remove identifying features wherever possible.
4. Who we share it with
We do not sell your personal data. We may share it, only as needed, with:
- Dentists and specialists within our practice involved in your care.
- Your referring dentist or doctor, and hospitals or specialists we refer you to.
- Dental laboratories that make crowns, aligners, dentures and similar appliances.
- Insurers, panel companies or your employer, where they are paying for your treatment.
- Service providers we use to run the practice, such as our clinic management system, cloud storage and messaging providers, who may only use it on our instructions.
- Our professional advisers, auditors and professional indemnity insurers.
- Government authorities, regulators or courts, where the law requires, or where needed to establish, exercise or defend our legal rights.
- A purchaser or successor, if all or part of our practice is sold, merged or transferred.
5. Cookies and third-party services on this website
- Google Ads: we use the Google tag to measure how our advertisements perform. Google may set cookies and collect information about your visit. You can manage this in your Google ad settings and read how Google uses data at policies.google.com.
- Google Maps: the map on our contact section is embedded from Google, which may set its own cookies.
- WhatsApp: messages you send us on WhatsApp are handled by WhatsApp (Meta) under its own privacy policy. We are not responsible for how WhatsApp, Google or other third parties handle your data.
- Offline storage: the site stores copies of its own pages and images on your device so it loads faster. This does not contain personal data.
You can block or delete cookies in your browser settings. The website will still work, although advertising measurement will not.
Some of these providers process data outside Malaysia. Where we transfer your personal data abroad, we take steps to make sure it remains protected to a standard comparable to the PDPA.
6. How long we keep it
We keep dental records for as long as required by Malaysian healthcare law and professional guidelines, and other personal data only for as long as needed for the purposes above. After that, we securely delete or anonymise it.
7. How we protect it
We use reasonable administrative, physical and technical safeguards, including access controls and confidentiality obligations on our staff and service providers, to protect your personal data from loss, misuse, unauthorised access or disclosure. However, no method of storage or transmission over the internet or messaging apps is completely secure. Information you send us electronically is sent at your own risk, and to the fullest extent permitted by law we are not liable for any unauthorised access to it that is beyond our reasonable control.
8. Your rights
Under the PDPA you may:
- Ask for access to the personal data we hold about you, and a copy of it.
- Ask us to correct personal data that is inaccurate, incomplete or out of date.
- Withdraw your consent, or ask us to limit how we process your data, including for marketing.
To make a request, contact us in writing using the details below. We may need to verify your identity before acting, may charge a fee for access requests where the law allows, and may refuse a request where the PDPA permits, for example where it would disclose another person’s personal data. If you withdraw consent, we may not be able to continue providing some services, and we may still need to keep certain records by law.
9. Children
We treat many children. Personal data about a patient under 18 is provided by, and handled with the consent of, their parent or legal guardian.
10. Changes to this policy
We may update this policy at any time by posting a new version on this page, with the date it was last updated. Your continued use of the website or our services after a change means you accept the updated policy. If this policy is translated, the English version prevails in the event of any inconsistency.
